ALTERNATIVE DISPUTE RESOLUTION (ADR) / ONLINE DISPUTE RESOLUTION (ODR)

If a consumer has submitted a claim/complaint regarding a contract entered into with L’Amande through this Website, but it has not been possible to resolve the dispute that is the subject of the claim/complaint, L’Amande will provide the consumer with information regarding the ADR bodies for the out-of-court settlement of disputes (so called ADR bodies, as indicated in Articles 141bis and ff. of the Consumer Code), specifying whether or not such bodies will be consulted to resolve the dispute.

Furthermore, an European platform for online resolution of consumer disputes has been established (so called ODR platform). The ODR platform can be consulted at the following address http://ec.europa.eu/consumers/odr/; through the ODR platform the consumer will be able to consult the list of ADR bodies, find the link to each of them and start an online resolution procedure for the dispute in which he is involved into.

Finally, according to the Article 49 para. 1 lit. v) of the Consumer Code, if the consumer intends to resolve a dispute arising with the merchant, the consumer can avail himself of the Joint Conciliation procedure. The procedure can be started if after submitting a claim/complaint to L’Amande, within 45 days, the consumer has not received a reply or has received a reply that he do not consider satisfactory. In any case, regardless of the outcome of the procedure for the out-of-court settlement of the dispute, without prejudice to consumer rights to refer to the ordinary judge, and, if the conditions are met, to promote an out-of-court resolution of disputes relating to consumer relationships by the procedures referred to in Part V, Title II-bis of the Consumer Code.
